一起水稻育秧事故损失的司法鉴定案例分析

A Case Analysis of Judicial Appraisal on the Economic Loss Caused by an Accident of Rice Seedling Culture

盐城市农业科学院司法鉴定所审核了委托人(T市法院)提交的鉴定材料之后,指派司法鉴定人对鉴定材料进行分析,对水稻育秧有机质土造成的损失进行鉴定。通过采用估算方法将机插秧预期产值减去直播稻的预期产值,用其产值之差减去实际未投入的插秧成本,再加上对额外投入的稻种成本进行估算,最终评估出涉案水稻育秧事故造成的经济损失为189700.70元。对造成的损失进行了评估,出具的司法鉴定意见在法院判决时被完全采信。

This study appraised an accident of rice seedling culture due to the use of low-quality organic soil for seedling culture in 2018,and determined the resultant economic loss of two farmers.After the Judicial Appraisal Institute of Yancheng Academy of Agricultural Sciences reviewed the appraisal materials submitted by the client(the court of T City),a forensic appraiser was assigned to analyze the appraisal materials and assess the economic loss caused by using the organic soil for growing rice seedlings.According to the estimation method,the expected output value of direct seeding rice was subtracted from the expected output value of machine-transplanted rice,resulting in the difference of the two output values.Then the rice-transplanting cost that had not been really put in was subtracted from the above value difference,and the resulting difference was added to the cost of additional input of rice seeds for direct seeding,which resulted in the estimated economic loss of 189700.7 yuan caused by using the low quality seedling-growing soil.Finally,the estimated economic loss and the judicial expertise opinion were fully accepted by the court when the case was judged.
