摘要
不动产统一登记实施以来,将以前分散在国土、住建、林业、农业等多个部门登记的土地、房屋、森林林木、草地、耕地、海域等不动产登记职责统一到一个部门,实现了登记机构、登记簿册、登记依据和信息平台“四统一”。不动产登记工作人员和不动产登记系统开发人员对房屋和土地一体登记的连续性、权利主体一致性、物权唯一性的理解程度直接决定了登记结果的正确与否。本文从对房屋和土地一体登记的正确理解出发,阐述了不动产单元状态和不动产权属状态的区别,阐释了不动产物权登记唯一性的原则;对不动产存量数据整合原因及不动产登记系统设置原因导致的不动产权登记信息重叠、权利主体不一致问题的处理对策;对土地首次登记证书收回产生的有关问题提出了解决建议。
Unified real estate registration unifies the registration responsibilities of land,houses,forests,grasslands,cultivated land,and sea areas into one department.It realizes the"four unifications"of registration agency,register,registration basis and information platform.To real estate registration staff and software development engineer,the understanding of registration continuity,right subject consistency,and property right uniqueness determines the accuracy of the registration results.This paper starts from the correct understanding of real estate registration,expounds the difference between the real estate unit status and the ownership status to explain the principle of the uniqueness of real property registration.Countermeasures for the overlapping of real estate right and inconsistency of right subjects caused by the data integration and the software settings.Some suggestions are put forward to solve the problems for decertified the first certificate of land registration.
