高校教师管理纠纷的法治思考——基于113份裁判文书的实证分析 被引量:1

摘要 本文通过对2006-2019年共113份涉及高校教师管理纠纷的裁判文书的分析研究表明,高校教师管理纠纷中行政案件数量不多,主要是以民事案由的面貌出现,案由主要涉及支付工资、社保待遇争议、解除聘任合同争议、职称评定争议等。为此,笔者提出要从厘清人事争议及劳动争议的法律标准、依法认定教师深造期间高校所支付的工资福利性质、依法明确服务期内教师申请离职的条件、建立高校教师管理纠纷多元解决机制等四个方面入手,提升高校教师管理纠纷依法处理能力,加大纠纷的防范与化解力度。 This article analyzes and studies a total of 113 judgment documents involving university teacher management disputes from 2006 to 2019.It shows that there are not many administrative cases in university teacher management disputes,which mainly appear as civil causes and involve payment of wages and social security.Disputes on treatment,termination of employment contract,disputes on title evaluation,etc.To this end,the author proposes to clarify the legal standards for personnel disputes and labor disputes,determine the nature of wages and benefits paid by colleges and universities during teachers further studies,clarify the conditions for teachers to apply for resignation during the service period,and establish a multiple resolution mechanism for college teacher management disputes.Start with four aspects to improve the ability of college teachers to handle disputes in accordance with the law,and increase the prevention and resolution of disputes.
