在优化营商环境背景下,民营企业家犯罪治理正实现由“差别保护观”到“平等保护观”的价值转向。平等保护观,要求治理民营企业家犯罪时应与国有企业家一视同仁,革除涉民企犯罪重刑化、刑罚化的弊病。除刑事立法的修正外,更应双管齐下:完善刑事诉讼法的司法程序保障,形成企业刑事合规方案,构建民营企业家平等保护机制。同时,需明确界定价值转向之边界,针对民营企业家的独有特点采取平等但有区分、有针对的治理举措,为民营企业生存和发展创造更好的营商环境。

In the context of optimizing the business environment,private entrepreneurs'crime governance is shifting from the concept of“differential protection”to the concept of“equal protection”.The concept of equal protection requires that when dealing with crimes committed by private entrepreneurs,they should be treated the same as state—owned entrepreneurs,eliminate the ills of heavy criminalization and penalization of private enterprises involved in crime.In addition to the modification of criminal legislation,it is also necessary to improve the criminal procedure system,form a corporate criminal compliance program,build an equal protection mechanism for private entrepreneurs.At the meanwhile,it is necessary to clearly define the boundary of value-turning,take equal but differentiated and targeted governance measures for the unique characteristics of private entrepreneurs,and create a better business environment for the survival and development of private enterprises.
