皋陶与中国法理学的萌生

Gao Yao and the Birth of Chinese Jurisprudence

依据《尚书》建构起来的文明建构逻辑与文明秩序原理,皋陶是中国历史上最早出现的思想人物与法律人物。借助皋陶之口阐述的法理学堪称中国法理学的源头与起点,在逻辑链条上堪称中国的“第一法理学”。皋陶论述了德的规范性,多层次地设定了君主的义务。在此基础上,皋陶以“典礼德罪”作为要素,为华夏文明秩序建构了一个基本的理论框架,阐述了中国本土最早的文明秩序原理。透过皋陶的法理学,可以解释华夏文明秩序的由来。

According to the logic of civilization construction and the principle of civilization order constructed by Book of History,Gao Yao is the first figure with ideological and legal consciousness in Chinese history.The jurisprudence expounded by Gao Yao is the“first jurisprudence”in China,the origin of Chinese jurisprudence.Gao Yao discussed the standardization of moral and set the obligations of the monarch at various levels.On this basis,Gao Yao constructed a basic theoretical framework for the order of Chinese civilization taking“policy,etiquette,morality and crime”as main elements and initiated the principle of Chinese civilization order.Through Gao Yao’s jurisprudence,the origin of the order of Chinese civilization can be elucidated.
