摘要
产权明晰是资源有效配置的前提,海域权属清晰是海域使用权流转的前提。海域使用权登记可以明确海域使用权的权利归属,确认海域使用权人对特定海域享有占有、使用、收益和处分的排他性权利。然而,我国现行《不动产登记暂行条例》对海域使用权登记的法律效力、法律依据、登记机构的规定存在明显的缺陷,不利于维护交易安全。因此,应对《不动产登记暂行条例》进行完善,使其与物权法的规定有效衔接。
Clear property right is the premise of effective allocation of resources,and clear ownership of sea area is the premise of transfer of sea area use right.The registration of the right to the use of sea areas can clarify the ownership of the right to the use of sea areas and confirm the exclusive rights of the right holder to possess,use,profit from and dispose of the specific sea areas.However,there are obvious defects in the legal effect,legal basis and registration organization of the registration of the right to the use of sea areas in China s current Interim Regulations on Real Estate Registration,which is not conducive to maintaining the security of transactions.Therefore,the Interim Regulations on Real Estate Registration should be improved so that it can effectively connect with the provisions of the Property Law.
