An Empirical Study of Fund Raising Fraud on Internet Loan Platform

作为一种新型犯罪行为,网贷平台集资诈骗犯罪除了具备一般犯罪的基本特征外,还受到互联网金融的创新性、网络环境的复杂性影响,使得相关案件在证据收集、法律适用、定罪量刑等方面产生了很多的问题和盲区。对此类案件进行研究,无论是在法律层面还是在现实层面都具有重大意义。因此,有必要立足于司法实践,探讨此类犯罪在实务处理中的现状、适用难点并以此为基础寻求解决之道。

The fund-raising fraud of online loan platform is a new crime in recent years.There are few related researches,criminals and citizens are intertwined,the facts are complicated,and the network and finance are intertwined,which brings many difficulties and challenges to judicial practice.Therefore,the study of such cases is of great significance both at the legal level and the practical level.For this reason,it is necessary to analyze and sort out the relevant rulings based on judicial practice,summarize the common difficult problems existing in the trial of fundraising fraud cases on the online loan platform,and explore solutions.
