Research on the Influence of Typical Force Majeure Events on Highway Construction Contracts

不可抗力事件往往造成人身伤亡、财产损失、费用增加或工期延期等后果,严重时还可能终止合同。论文研究了瘟疫类典型性不可抗力事件对公路工程施工合同履行的影响,提出因不可抗力造成工期延误、费用增加的处理原则及处理程序,为发包人及承包人双方处理此类合同争议提出建议。

Force majeure events often lead to the results such as personal injury or death,property loss,cost increase or construction period extension,etc..The contracts are terminated when the events are serious.This work studies the influence of typical plague force majeure events on the performance of highway construction contracts.The principles and procedures for handling construction delay and cost increase due to force majeure are proposed.Advice on handling such contract disputes is also given to both the employers and the contractors.
