专利伦理研究的是专利制度在运行实践中应当遵循的价值观念、伦理准则和道德规范。作为技术性的法律规范,专利制度与技术伦理及法律伦理密切相关,而新兴技术的不断涌现则使技术伦理问题在专利制度运行中尤为凸显。为实现专利制度运行的伦理契合性,应在实践中遵循以人为本的主体性原则和与人为善的有益性原则,并通过科学的架构安排、多元的衡量指标及合理的运转程序建构起相对健全的伦理评价体系,确保专利制度运行的伦理正义。

Ethics of patent focuses on what should be abided by the values, ethical principles and moral norm in the practice of patent system operation. As a technical legal system, patent system is closely related to technical ethics and legal ethics. While, the continuous emergence of new technologies makes the technical ethics issues particularly prominent in the operation of the patent system. In order to realize the ethical fit of patent system operation,it is necessary to follow subjectivity principle and the beneficial principle in practice and establish a relatively sound patent ethics evaluation system by setting up scientific structure, multiple measurement indicators and reasonable operation procedures to ensure the ethical justice of patent system operation.
