摘要
涉案财产价格认定在我国已有30多年的历史,却长期游离于司法鉴定管理体制之外。本文扼要回顾了以往的历史,指出其存在的问题:虽具有司法鉴定的属性,但始终不是真正的司法鉴定,并且近5年来原有的司法鉴定属性也荡然无存。即使如此,价格认定结论始终被当作诉讼证据,对定罪量刑具有重要影响。应当将涉案财产价格认定改革为司法鉴定,使价格认定结论名正言顺地作为诉讼证据,并经法定程序查证属实后成为定案的依据。同时,对涉案财产价格认定工作的管理实行双轨制:一方面继续由政府价格主管部门负责行政管理,另一方面由政府司法行政部门负责业务管理,对价格认定机构和认定人员进行统一登记管理。
The price determination of the property involved has a history of more than 30 years in China,but it has been dissociated from the administration system of judicial expertise for ages.This article briefly reviews the past and points out its existing problems:although it has the attribute of judicial expertise,it is not all long the authentic judicial expertise,and its original attribute of judicial expertise has disappeared in recent five years.Even so,the conclusion of price determination is always regarded as evidence in litigation,which has an important influence on conviction and sentencing.Therefore,the price determination of the property involved should be transformed into judicial expertise,that would enable the conclusion of price determination as the litigation evidence justifiably and as the basis for verdict after verification by legal procedure.Meanwhile,the two-track system shall be applied to the management system of the price determination of the property involved.On the one hand,the government price department will continue to be responsible for the administrative management,and on the other hand,the judicial administrative department should take charge of the business management,to carry out unified registration administration for price-determining institutions and personnel.
