疫情防控下电子劳动合同的发展与法律应对

摘要 疫情防控形势下,电子劳动合同逐渐获得认可。电子劳动合同具有优化合同订立流程、便捷企业内部管理、减少企业管理成本及降低隐性风险等突出优点。电子劳动合同的出现是技术发展、现实需求和政策认可的共同成果。电子劳动合同作为新内容,面临用人单位和劳动者协商一致的前提条件没有落实、电子劳动合同所依赖的技术存在安全隐患及行政机关保障和监管作用不足等问题,需从落实规范实施、以法律制度给予技术保障及强化行政监管等方面做出回应。 Under the situation of epidemic prevention and control,electronic labor contracts have gradually gained recognition,which have outstanding advantages such as optimizing the contract formation process,facilitating internal management of enterprises,reducing enterprise management costs and hidden risks.The emergence of electronic labor contracts is a unified result of technological development,actual demand and policy recognition.As a new kind of thing,electronic labor contracts are faced with issues such as the failure to implement the preconditions agreed upon by employers and workers,the hidden dangers in their technical safety,and the insufficient protection and supervision of administrative agencies,which may be tackled through providing technical support and strengthening administrative supervision and other aspects.
