“三权分置”视阈下农村宅基地退出机制探索

Research on the Exit Mechanism of Rural Homestead under the Background of the Separation of Rights

随着我国经济的快速发展和城镇化的推进,大量在城镇务工的农民工逐渐购房定居下来,农民"一户多宅"现象日渐突出,宅基地闲置浪费问题亟待解决。宅基地退出探索在取得一定进展的同时,也存在着一些问题,如农民退出宅基地的积极性不高、补偿资金不足以及农民的社会保障机制不完善等。应以"三权分置"为架构,尽快在法律上将宅基地的资格权和使用权明确化,探索多元化退出机制,并加强农村社会保障配套制度建设,我国宅基地退出机制改革才能取得最终成功。

With the rapid development of economy and the advancement of urbanization in our country,a large number of rural migrant workers have gradually purchased houses and settled down in cities and towns.One household with multiple houses has become increasingly prominent.We have made progress in the exploration of the exit mechanism of rural homestead,and also have some problems to solve,such as the low enthusiasm of farmers in the exit of rural homestead,insufficient compensation funds and imperfect social security mechanisms for farmers.Under the background of the separation of rights,we should clarify the qualification right and the use right of homesteads in law as soon as possible,explore diversified exit mechanisms and strengthen the construction of rural social security systems.
