人口老龄化背景下老年人赡养权益保障研究——以500份赡养纠纷判决书为分析样本

An Empirical Study on Support Disputes under the Background of Population Aging——Take 500 Judgment Documents as the Research Object

在中国人口老龄化背景下,养老是一项重要的社会议题。采用实证研究方法,对500份涉赡养纠纷判决书进行分析研究发现:老年人赡养权益保障面临孝道观念淡化、法律调控有限、精神赡养难实现、经济因素制约、子女养老压力大等困境。建议:重整孝道文化,宣扬新型孝道;完善赡养法律,增加惩罚条款;完善调解制度,注重精神赡养;提供政策支持,加强社会保障。

In the context of China’s aging population,elderly care is an important social issue.Using empirical research methods and conduct analysis and research of 500 judgments involving support disputes,and it turns out that:the old people’s rights and interests are facing difficulties dilution of filial piety concept,limited legal regulation,difficulty in achieving spiritual support,economic constraints,and high pressure on children to provide for the elderly.Suggesions:reorganize the culture of filial piety and promote a new type of filial piety;improve the maintenance laws and increase punishment clauses;improve the mediation system and focus on spiritual maintenance;provide policy support and strengthen social security.
