法治氛围的功能探究——以“素媛案”为视角

Study on the Functions of Atmosphere of the Rule of Law--from the Perspective of So-Won Case

作为一种社会状态,法治氛围反映着社会主体的心理情绪、精神气质和价值取向;作为一个变迁过程,法治氛围乃是社会成员共同建构的历史延续;作为一种发展动力,法治氛围不断为社会主体提供法律场域和舆论背景,为社会主体提供学习法律知识和行为模式的平台。法治氛围潜在地诱发、引导、推动、规范着社会主体的活动,有助于培育法治文化,使民众认识法治、认同法治;有助于凝聚法治共识,使民众尊重法治、崇尚法治;有助于引导主体行为,使民众践行法治、维护法治。

As a social state,the atmosphere of the rule of law can reflect the emotions,spiritual temperament and value orientation of social subjects.It is changing and continues the history which is constructed together by members of the society.As a driver to the social development,the atmosphere of the rule of law provides the social subjects with space for the law development and background for public opinions,and offers a platform for social subjects to learn legal knowledge and behavior platforms.The atmosphere of the rule of law potentially induces,leads,drives and regulates the activities of social subjects.It can cultivate the culture of rule of law and help the public to better know the rule of law.It is favorable to building consensus about the rule of law and encourages the public to uphold the rule of law.It will guide the subject behaviors,encouraging the public to practice and sustain the rule of law.
