虚假诉讼法律监督联动协作机制研究

Research on the Linkage and Cooperation Mechanism of Legal Supervision of False Litigation

由于工作机制不健全,目前虚假诉讼监督工作存在不少薄弱环节。为了更好地监督和惩治虚假诉讼,检察机关宜多管齐下、内外兼修,建立健全虚假诉讼监督联动协作机制。在政法领域,检察机关应当积极争取党委支持,强化与其他司法机关的沟通联系,统一认识、紧密配合,形成打击合力,以会签文件的方式建立联动协作工作机制。在检察系统内部,应当完善相关工作机制,实行上下级一体化办案、各部门横向协作、检察长靠前指挥,加大虚假诉讼监督工作力度。

Due to the imperfect working mechanism,there are many weak links in the supervision of false litigation.In order to better supervise and punish the false litigation,the procuratorial organs should take multi-pronged approach,and establish and improve the linkage mechanism of supervision and cooperation of false litigation.In the field of politics and law,the procuratorial organs should actively strive for the support of the Party committee,strengthen the communication with other judicial organs,unify the understanding,closely cooperate,form a joint effort,and establish a linkage and cooperation working mechanism by means of countersignature.Within the procuratorial system,the relevant working mechanism should be improved,the superior and subordinate should be integrated in handling cases,the departments should cooperate horizontally,the chief procurator should take the lead,and the supervision of false litigation should be strengthened.
