我国对环境犯罪的立法修改呈现出愈加严格的趋势,包括入罪门槛降低,刑罚力度加大,罪名精细化等,该种做法也取得了一定成效。但是,随着生态保护意识的全面强化,污染环境罪的入罪与量刑问题仍难以满足现实需要。针对本罪的特殊性质,需要进一步明确相关定性内容,刑罚上增设资格刑,并合理规定罚金刑。

The punishment against environmental pollution accidents tends to be stricter in the aspects of conviction,penalty,accusation,etc.The above measures are effective to some degree.But with the increasing people’s awareness of ecological protection,the conviction and penalty for such offences lags behind legal proceeding.Due to the specific properties of such crimes,the environmental legislation should add qualitative requirements like qualification punishment,and stipulate certain provisions for fine punishment.
