国家资历框架立法的现实诉求及其立法思考 被引量:9

摘要 国家资历框架是沟通衔接各级各类教育的桥梁,对于中国终身教育事业起着基础性的作用。面对中国公民终身学习权亟须保障、国际教育与文化交流推进遇阻、不同教育体系下资格转换困难、教育体系与就业市场脱节等现实诉求,国家资历框架立法势在必行。事实上,中国资历框架的立法工作已具备坚实的法律与政策基础和丰富的实践经验,基于学习权本位、公平性和开放性的立法原则,确立以立法服务对象为出发点,以学习成果框架为基石,以学分转换为核心,以组织管理为抓手,以质量评审为保障的统筹机制,才能推动国家资历框架的规范性和长效化建设。 The national qualification framework is a bridge connecting various levels of education,which plays a fundamental role in China’s lifelong education.Faced with realistic demands such as Chinese citizens’right of lifelong learning being unable to be guaranteed,international education and cultural exchange being blocked,national education systems being not well connected,and the integration of education system and job market being not smooth,the legislation of national qualification framework is imperative.In fact,the legislative work of China’s qualification framework has already possessed a solid legal and policy foundation and rich practical experience.we should establish the legislative principles of the right to study first、fairness and openness.We will make overall plans to improve the system design in legislative service objects,learning outcome framework,credit recognition,accumulation and conversion,and organization and management mechanism,to promote the standardization of the national qualifications framework and long-term construction.
