摘要 从所涉及的议题来看,儒家人权话语在内容上可以概括为"儒家—人权"的有无论、历史论、关系论和建构论。儒家—人权有无论因为判断"有无"标准的差异,而存在着"古无有也""古已有也"和"本无后有"的种种具体论争。儒家—人权关系论在具体内容上可区分为"相斥论""相融论"和"转化论"。儒家—人权历史论中包含了往往为人们所忽略的人权"东学西渐"问题,中国传统儒家思想对西方人权观念和规范文本的形成均产生过影响。儒家—人权建构论中"潮汕新儒家"的代表杜钢建,通过"仁学"系统地建构了儒家人权论体系。综合来看,儒家人权话语处于中西古今之间的纵横交错点上,人权的"公度性"正是在这一点上产生的。 As to the contents of Confucian discourse of human rights there are four topics which are being or not-being,history,relationship and constructivism on Confucian-human right.According to the different criteria of being or not being on Confucian-human right there are three points:not being in ancient times,being in ancient times,not being originally and being later.There are three points too on relationship of Confucian-human right:exclusion,integration and conversion.What is sometimes overlooked on the history of Confucian-human right is eastern studies introduced to the west.The traditional Chinese thoughts had an important effect on western human right idea and normative text.DuGangjian,a well-known expert on Chaoshan new confucianism in construction of Confucian-human right,constructs a theory system of confucian human rights by confucius idea.Taken together,Confucian discourse of human rights is at the crosssection when China mingled with the western countries and the modern replaced the ancient.The commensurability of human rights is just made at this point.
