摘要
以译者惯习理论为视角,考察19世纪英国汉学家小斯当东的法律典籍翻译实践,揭示译者惯习对《大清律例》翻译活动的影响。认为译者借翻译法典促进英中两国沟通,本质上是语言惯习作用下的主动诉求。受政治惯习指挥,译者为满足英国殖民扩张与贸易需求,在翻译过程中综合运用删节、改写、解释等策略保证了译本的可读性与准确性。在学术惯习的规约下,译者追求汉学研究的实用性,译本因实用价值高而得到充分认可。
Based on the theory of "translator’s habitus", the paper examines the legal translation practice by George Thomas Staunton, a 19th century British sinologist, and reveals the effect of his habitus on the translation of Ta Tsing Leu Lee. It is held that his translation aims to promote communication between Britain and China, which in essence is an active appeal influenced by his linguistic habitus. Directed by his political habitus, the translator makes comprehensive use of strategies like omission, rewriting and explanation, ensuring the readability and accuracy of the translation and meeting the colonial expansion and trade demand of Britain. Stipulated by his academic habitus, the translator seeks practicality of Sinology and his translation is highly recognized for its usefulness.
