罪错未成年人保护处分实务研究——以上海市M区为样本

A Practical Study on the Protection and Punishment of Juvenile Delinquents--Take M District of Shanghai as the Sample

以教育和保护为目的对罪错未成年人实施保护处分,对于预防违法犯罪具有重要意义。经研究分析M区人民检察院2018-2019年间办理的罪错未成年人保护处分案件,当前罪错未成年人保护处分工作存在适用理念和条件认识不正确、相关单位职责不清、专门学校资源没有充分利用、收容教养措施缺乏强制性和可操作性等问题。对此,应更新理念,完善立法规定,制定未成年人差异化构罪标准,建立分级化处遇流程,建构我国的保护处分制度。

Taking education and protection as the aim,it is of great significance for the prevention of crimes to take protective measures against juvenile delinquents.Having studied and analyzed the cases of protection and punishment of juvenile delinquents handled by M district procuratorate between 2018 and 2019,at present,there are some problems in the protection and punishment of juvenile offenders,such as incorrect understanding of the applicable concepts and conditions,unclear responsibilities of relevant units,insufficient utilization of resources in special schools,and lack of compulsory and operability measures in the adoption and rehabilitation of juvenile offenders.Therefore,we should renew the idea,perfect the legislative provisions,establish the differential constitutive standards for minors,establish the process of classification,and construct the system of protection and punishment in China.
