老龄化背景下超龄就业者的法律保护问题研究 被引量:1

摘要 随着我国人口老龄化速度不断加快,超龄就业已成为我国劳动力市场日渐普遍的用工现象。但该群体是否属于劳动法调整范围仍存争议,相关立法的缺失导致司法态度多元化,致使超龄就业者难以享受基本的劳动权益,超龄就业纠纷不断。基于超龄用工关系的法律本质,我国立法应正视超龄就业者劳动权利,为其建立特殊的社会保险制度,健全相关劳动保护制度,加强超龄就业的引导和管理,以解决老龄化背景下的超龄就业问题。 With the acceleration of the aging of China’s population,over-age employment has become an increasingly common phenomenon in Chinese labor market.However,it is still controversial whether this special group belongs to the scope of the labor law,and the lack of relevant legislation leads to the diversification of judicial attitudes,which makes it difficult for over-age workers to enjoy basic labor rights and interests,and over-age employment disputes continue.Based on the legal nature of the relationship of over-age employment,Chinese legislation should confront the labor rights of over-age workers,establish the special social insurance system for them,improve the relevant labor protection system,and strengthen the guidance and management of over-age employment,in order to solve the problem of over-age employment in the context of population aging.
