从“漠视”到“重视”:媒体融合中媒体保护版权的历史演进

From “indifference” to “emphasis”: the historical evolution of media copyright protection in media convergence

版权是媒体内容的精神权和财产权合法身份的符号,同时也是媒体的核心利益所在,媒体融合中媒体理应对版权保护予以高度重视,对此,西方实践予以了印证。然而,中国的经验表明,媒体融合中无论是传统媒体还是新兴媒体都根据自身利益变化调整着对版权保护的理解和作为,从整体上看,两类媒体对版权保护呈现了从"漠视"到"觉醒"再到"重视"的历史演进过程。这样的演进一方面展示出了媒体融合中我国媒体版权保护的特殊性,另一方面,也可发现,媒体融合纵深发展正成为影响中国媒体保护版权正向作为的一大结构性因素。

Copyright is not only the symbol of the spiritual right and the legal status of the property right of the media content, but also the core interest of the media. In this regard, the practice of the West should be proved. However, China’s experience shows that both traditional media and emerging media adjust their understanding and actions of copyright protection according to their own interests. As a whole, the two types of media have experienced a historical evolution from "indifference" to "awakening" and then to "emphasis". On the one hand, this evolution shows the particularity of media copyright protection in China. On the other hand, it can also be found that the in-depth development of media integration is becoming a major structural factor affecting the positive action of media copyright protection in China.
