从新冠肺炎疫情谈经济法的民生保障功能及其完善

在新冠肺炎疫情的影响下,我国乃至全球社会经济都受到了极大的冲击,医疗卫生与部分防疫生活用品的短缺使得市场自身调节机制失灵,而政府也因前期的防治措施不到位出现失灵现象。在双"失灵"的情况下,经济法应以"安全、秩序、公平、发展"为价值目标,在恢复市场秩序、保证中小微企业等市场主体生存以及恢复市场活力上,发挥疫情时期对基本民生的保障功能。但在发挥作用时,也存在对涨价行为矫枉过正、政府宏观调控的惠及政策实施力度不够以及在为短期提振经济而发放消费券时没有充分考虑公平公正原则等问题。因此,经济法在疫情期间继续发挥民生保障作用,除了要充分把握疫情的特殊性,还要在保证安全、秩序上兼顾公平、效率和发展。

Under the influence of Novel coroavirous pneumonia,China and the global economy have been greatly impacted.The shortage of medical products and some epidemic prevention daily necessities has caused the market failure,and the government failure has also happened due to the lack of prevention measures at the beginning of the epidemic prevention.Because of double failures,the economic law should take"security,order,fairness,and development"as the value goal,and play a fundamental role in the restoration of market order,ensuring the survival of market entities such as small and medium-sized enterprises,and restoring market vitality,to protect people’s livelihood.However,there are also problems such as overcorrection of price increases,insufficient implementation of government macro-control policies,and insufficient consideration of the principles of fairness and fairness when issuing consumer coupons to boost the economy in the short term.Therefore,the economic law should play a role in ensuring people’s livelihood during the epidemic.In addition to fully grasping the particularity of the epidemic,it must also take fairness,efficiency,and development into account while ensuring safety and order.
