在宏观层面,主要针对德国文化遗产保护规范的立法属性、立法目的以及立法结构等内容进行背景式的介绍性分析;在微观层面,以法律关系为分析工具,主要针对德国文化遗产保护制度中的主体、客体、公权主体的职责以及私权主体的义务和权利等事项进行窥探式的阐述性分析。以上制度内容在外部呈现出趋同性的发展脉络,在内部表现出内涵式的变化走向。我国在文化遗产保护规范制度性优化方面可以借鉴德国的相关立法经验,在制度内容构建方法和丰富程度方面进行转向和提升。

On the macro level,introductory analysis on the legislative attributes,legislative purpose,and legislative structure of norms on protection of cultural heritage inGermany with background is mainly conducted;On the micro level,using tools of legal relations and focusing on the subject,object,responsibilities of public subject,obligations and rights of private subject,the analysis with method of spying explanation is mainly conducted. The institutional content mentioned above externally shows a convergent main line of development and internally a connotative change trend. In terms of institutional optimization of norms on protection of cultural heritage,China can learn from Germany ’s relevant legislative experience,and make changes and enhancements in the constructing method and richness of institutional content.
