规制四阶层论的形成机理、内容构造与运用实践——基于规制国理论与后规制国理论的思考

现有规制理论研究大致分为规制国理论和后规制国理论。通过考察规制国理论和后规制国理论的内容及其研究历程,规制的四阶层结构逐渐清晰。规制国理论中的规制控制和后规制国理论中的规制治理为规制四阶层结构提供了具体内容。规制四阶层论正是建立在规制控制和规制治理基础上,由规制治理、法律规制、政府规制和市场监管四部分组成,并形成了由一阶规制、二阶规制、三阶规制和四阶规制构成的具有嵌套特征的规制四元交互结构。规制四阶层论在经济法中的运用为经济法规制提供了体系化阐释。其中,规制治理是经济法规制的方向,法律规制是经济法规制的形式,政府规制是经济法规制的实质,市场监管是经济法规制的手段。

The existing research on regulation theory can be roughly divided into the theory ofregulation state and the theory of post-regulation state. The four-stratum structure of regulation gradually emerged after sorting out the content and research process of the theory of regulatory state and post-regulatory state. The regulatory control in the theory of regulatory state and the regulatory governance in the theory of postregulatory state provide specific content for the four-stratum structure of regulation.The theory of four levels of regulation is based on regulation control and governance.It consists of four parts: regulation governance, legal regulation, government regulation,and market regulation. A regulatory four-element interactive structure is formed by first-level regulation,second-level regulation,third-level regulation and fourth-level regulation. The application of the theory of four stratum of regulation in economic law provides a systematic interpretation of regulation of economic law.Among them,regulatory governance is the direction of regulation of economic law,legal regulation is a form of regulation of economic law,government regulation is the essence of regulation of economic law, and market supervision is a means of regulation of economic law.
