明确社区矫正任务是做好社区矫正工作的前提。社区矫正是将法院的刑事裁决加以实现的过程,教育矫正固然重要,但是惩罚的任务不能忽视。因为刑罚和刑罚执行的本质属性是它的惩罚性。惩罚是对犯罪人权益给予一定的限制和剥夺,让其承受一定痛苦与损失的体验。惩罚的形式、内容和强度需根据罪责刑相适应的原则在刑事法律中加以确认并在执行中加以实现。在社区矫正中,需要正确平衡惩罚与教育矫正的关系。如果过分强调教育矫正和人权保护而忽视或否认惩罚,将会削弱刑罚的威慑和伸张正义的功能,在一定程度上是对犯罪的宽纵。"监督管理"并不能等同于惩罚。适应性帮扶作为社区矫正的任务值得商榷。

A clear task is a prerequisite for community corrections.Community correction is the process of realizing the criminal ruling of the court,education correction is important,but the task of punishment cannot be ignored,because punitiveness is the essential attribute of punishment and execution.Punishment is a certain restriction and deprivation of the rights and interests of the offender,and the experience of suffering and loss.The form,content and intensity must be confirmed in the criminal law according to the principle of crime,responsibility and punishment and implemented in the execution.In community corrections,it is necessary to correctly balance the relationship between punishment and education correction.If excessive emphasis is placed on education,correction and human rights protection,it will weaken the deterrence and justice function of penalties,and lenient crimes."Supervision and management"is not the same as punishment.As the task of community correction,adaptive assistance is debatable.
