互联网信息监管领域行政约谈理论分析与制度完善

Theoretical Analysis and System Improvement of Administrative Interview in the Field of Internet Information Supervision

随着“约谈十条”的实施,互联网信息监管领域中实施行政约谈愈发常见,随之也暴露出诸多问题,如性质难以界定、各部门法律规定不统一、异化为强制等,因此需要对互联网信息监管领域中的行政约谈进一步研究及完善。本文提出跳出行政行为论的框架,从行政过程论的视角看待行政约谈的性质问题,并提出明确各部门管辖范围、对约谈十条进行修订、明确约谈启动程序等完善建议。

With the implementation of article 10 of"Questioning",the Internet increasingly common in the field of information supervision in administrative interview,then it also exposed many problems.Such as the nature is difficult to define,departments for mandatory law is not unified.Administrative interview in the field of Internet information supervision is questioning further research and perfect.This paper proposes to solve the nature problem of administrative interview from the perspective of administrative process theory,and puts forward some suggestions for improving the scope of jurisdiction of each department,revising article 10 of"Questioning",and clarifying the starting procedure of administrative interview.
