信赖保护原则在规范性文件制定中的设定研究--以《北京市牌匾标识设置管理规范》为例

Research on the Establishment of Trust Principle in the Formulation of Normative Documents--Take Beijing Plaque Management System Standards as an Example

信赖保护原则作为行政法的一项重要原则,在行政法中的地位日渐突出。为了及时解决地区或部门所独有的但并不十分重要的问题,需要规范性文件进行相应的补充。但规范性文件因其自身的局限性,极易侵犯公民的信赖保护利益。本文以最新颁布的《北京市牌匾标识设置管理规范》为例,研究信赖保护原则在规范性文件制定过程中的设定问题,并对规范性文件制定过程中容易受到侵害的信赖保护利益行为进行分析,最后为完善行政规范性文件中的信赖利益保护的体制构建提出几点设想。

The principle of legitimate expectation is an important principle of administrative law,and its status in administrative law is increasingly prominent.The administrative rule of law in our country is not perfect at present.In order to solve problems that are unique but not very important in a certain area or department,normative documents should be supplemented accordingly.However,due to its limitations,normative documents often infringe on the trust and protection interests of citizens.This paper takes the newly promulgated Beijing Plaque Management System Standards as an example to study the application of the principle of trust protection in the process of making normative documents.It also analyzes the behaviors that violate the interests of trust and protection in the process of making normative documents and process solutions.
