论党内程序性规范的历史嬗变及发展面向

On the Historical Evolution and Development Orientation of Procedural Norms within the Party

党的十八大以来,党内法规制度得到了前所未有的发展,但囿于我国长期以来重实体而轻程序的法制传统影响,党内程序性规范的功能与作用还未能受到应有的重视。历史地看,党内程序性规范历经了萌芽期、探索期及发展期,具有法治化、规范化、体系化的发展趋势。根据党内法规制度体系建设的总要求,党内程序性规范的发展应当以“程序严密”为目标,以“便利管用”为原则,以“规范权力运行”为内在机理,架构起与实体性规范体系配套的程序性规范体系,从而提高党内法规制度体系的科学性、系统性、有效性。

Since the 18th National Congress of the Communist Party of China,the party’s internal laws and regulations have undergone unprecedented development.However,due to the long-standing influence of our country's long-standing legal tradition that emphasizes entities rather than procedures,the functions and effects of procedural norms within the party have not received due attention.Historically,the procedural norms within the party have gone through a budding period,an exploratory period and a development period,and have a development trend of rule of law,standardization,and systemization.In accordance with the general requirements for the establishment of the party's legal system,the development of procedural norms within the party should aim at"strict procedures",the principle of"convenience and effectiveness",and the internal mechanism of"regulatory power operation".The procedural standard system supporting the standard system will improve the scientific,systematic and effective of the party's legal system.
