新形势下境外企业档案管理面临的问题及对策研究

Research on the Problems and Countermeasures of Enterprises’Overseas Archives Management under the New Situation

近年来,境外企业档案管理在商业模式、分工体系、法律环境和保管环境等方面面临着更加复杂多变的新形势,尤其是新冠肺炎疫情在全球范围内暴发以来,“区域化”“合规审查”“安保”“虚拟化”等成为我国境外企业档案管理研究离不开的热词。上述新形势更是带来了境外档案管控类型更加复杂、管理流程断裂、合规体系有待完善、监管系统较为薄弱等问题。针对上述问题,文章建议从明确境外文档管理的权限范围、建立双循环的境外档案发展圈、建立明确的境外档案法律风险体系、建立全面的境外档案工作监管体制等方面应对。

In recent years,overseas enterprise archives management has faced a more complex and changeable situation in terms of business model,division of labor,legal environment and custody environment,especially since the outbreak of the COVID-19 on a global scale.Regionalization,compliance audit,security and virtualization have become the buzz words that Chinese overseas buiness archives management cannot avoid.The above-mentioned situation has brought some related problems,including of more complicated types of overseas archives,the broken of the management process,the incomplete compliance system,and the relatively weak supervision system.In response to the above problems,it is recommended to take countermeasures in terms of clarifying the scope of authority for overseas archives management,establishing a dual-cycle overseas archives development circle,establishing a clear legal risk system for overseas archives,and establishing a comprehensive archival management system.
