简论我国战略石油储备运营制度相关法律问题

Brief Discussion on the Legal Issues Related to the Operation System of China's Strategic Petroleum Reserve

时至今日,我国战略石油储备工程整体建设已经取得一定成效,初步建成后,理应思考如何建设和完善与之配套的运营制度,从而可以以更好地保障我国的能源安全与经济的可持续发展。基于此目的,通过文献分析法,历史分析法与比较分析法研究了战略石油储备运营制度在我国的发展历史与现状,在反思不足的基础之上,结合现有实践经验,得出了在未来我国应加快完善立法以保证在运营领域内有法可依,明确政企权责划分以保证在运营领域内给予市场主体充分保障,增强动态运营活力以更好发挥战略石油储备的经济效益,推动商业储备市场化以提高市场参与主体积极性等措施来健全我国战略石油储备运营制度的重要结论。

Up to now,the overall construction of China's strategic petroleum reserve project has been achieved,after that,how to build and improve the supporting operation system should be considered,so as to better guarantee China's energy security and sustainable economic development.Based on this purpose,this article through literature analysis,historical analysis and comparative analysis to study the strategic petroleum reserve operating system development history and present situation in China,on the basis of inadequate reflection,combining with the existing practical experience,coming to the conclusion that in the future,China should speed up make legislation to ensure that the operation laws within the territory,clear enterprise power and responsibility division of market main bodies should be in place to ensure that the operation field,enhance the vitality of the dynamic operation in order to better play to the economic benefits of strategic oil reserves,To promote the marketization of commercial reserves to improve the enthusiasm of market participants and other measures to improve China's strategic petroleum reserve operation system.
