乡村振兴战略下非物质文化遗产文创产业开发中的法律困境与对策

Legal Difficulties and Countermeasures in the Development of Cultural and Creative Industries of Intangible Cultural Heritage under the Strategy of Rural Revitalization

开发非物质文化遗产文创产业是乡村振兴的重要措施,而当下开发文创产业面临文创开发授权主体模糊、传统文化价值被篡改与歪曲、文创产品被侵权等困境。在借鉴美国文创开发著作权高强度保护政策及法国文化遗产开发中“文化保护原则”经验的基础上,提出明确文创产业开发主体、加大非物质文化遗产开发的法律规制、强化开发过程中的知识产权保护、破除当下非物质文化遗产文创产业开发困境等建议。

The development of cultural and creative industries of intangible cultural heritage is an important measure for the rural revitalization. However, at present, the development of cultural and creative industries encounters the dilemma of vague cultural and creative rights, the distortion of traditional cultural values, and the infringement of cultural and creative products. Based on the experience of the high-intensity copyright protection policy in the United States and the "cultural protection principles" in French cultural heritage development, some suggestions were put forward, such as clarifying the main body of cultural and creative industry development, strengthening the legal reg ulation of intangible cultural heritage development, strengthening the protection of intellectual property rights in the development process, and breaking the current predicament of cultural and creative industry development of in tangible cultural heritage.
