诚实信用原则日益在劳动法领域发挥作用。其对于平台型灵活用工的特殊意义在于:灵活用工平台化需要平台的最大诚信,灵活用工平台化赋予各方更大的说明义务,平台化灵活用工对诚信履行提出更高要求。诚实信用原则在平台型灵活用工的法律适用分为"基于行为控制功能的适用""基于限缩解释功能的适用"和"基于漏洞补充功能的适用"三类。第一类主要包括:各方禁止反言、平台合同条款不得违反诚信原则;第二类主要包括:对赋予自身权利条款的限缩解释,对限制其他各权利条款的限缩解释和对平台自身免责条款的限缩解释;第三类主要包括:要求合同各方履行附随义务,赋予平台对双方当事人的基本权利的注意义务以及对平台课以限制双方违约或侵权的义务。

The principle of good faith is increasingly at play in the field of labor law.Its special significance for platform-based flexible employment is that the platform-based flexible employment requires the utmost integrity of the platform,the platform-based flexible employment imposes greater obligations on the parties to explain,and the platform-based flexible employment imposes higher requirements on the performance of integrity.The legal application of the principle of good faith in platform-based flexible employment is divided into three categories:"application based on behavior control functions","application based on limited interpretation functions"and"application based on loopholes and supplementary functions".The first category mainly includes:estoppel of the parties and the platform contract terms shall not violate the principle of good faith;the second category mainly includes:the restrictive interpretation of the terms that grant their own rights,the restrictive interpretation of the terms that limit each other’s rights and the restrictive interpretation of the platform’s own exclusion clauses.The third category mainly includes:requiring the parties to the contract to perform the accompanying obligations,giving the platform the duty of care to the basic rights of the parties and the obligation of the platform to limit the default or infringement of the parties.
