摘要 近年法学交叉领域研究日益活跃,作为与工学交叉的法学边缘学科,工程法学自概念提出以来,便面临着内生理论架构的先天不足。工程法学学科培育需从法律概念解构走向经由基础理论指引的自我证成。领域分际、规范集成与方法创新是领域法学对构建内容完整、逻辑自洽的工程法学学科体系带来的启示。领域分际是对工程法学研究对象的定位,体现领域法学强烈的问题导向,划定了工程法学的知识边界;规范集成是在社会规范视域下对技术和法律的协调,体现工程法学学科独特的学科地位,明晰了工程法学的领域法属性;方法创新是在问题意识的基础上对事实与规范之间距离的弥合,体现了法学研究方法论的中国贡献,有助于工程法学在传统与创新、分化与整合之间走向一条学科体系构建优化之路。 In recent years,the interdisciplinary law study has become increasingly active.As a marginal discipline of law that intersects with engineering,engineering law is born with the deficiencies in the theoretical framework since the concept has been proposed.The cultivation of engineering law discipline needs to go from the deconstruction of legal concepts to self-justification guided by basic theory.Domain demarcation,normative integration and method innovation are the paths to construct a complete and logically self-consistent engineering law discipline system.Domain demarcation helps to position the research object of engineering law,reflecting the strong problem orientation of domain law and delineating the knowledge boundary of engineering law;normative integration is to coordinate technology and law from the perspective of social norms,reflecting the uniqueness of engineering law and clarifying its domain legal attributes;method innovation is to bridge the gap between facts and norms on the basis of problem consciousness,which reflects the Chinese contribution to legal research methodology and helps engineering law develop on the road towards the construction with its optimal discipline system between tradition and innovation,differentiation and integration.
