Forest Farmers’ Ecological Rights Protection in China and Its Institutional Paths

生态权益是公民基本权益体系中非常重要的组成部分。文中以环境权益的发展过程为切入点,针对我国林农生态权益保护相关制度不完善、保护较弱等问题,具体阐述林农生态权益的内涵,探讨林农生态权益保护存在的不足,提出林农生态权益保护的制度路径,即确保林农生态权益保护制度和执法体系不断完善,确保林农知情权、参与权和救济权等得以实现。

Ecological rights and interests is an important part of citizens’ basic rights and interests. With an eye to the problems such as the unsound system of forest farmers’ ecological rights and interests protection and resulting weak protection in China, this paper specifically expounds the connotation of forest farmers’ ecological rights and interests, and discusses the deficiencies in the rights and interests protection from the perspective of the development process of environmental rights and interests. The institutional path for the protection is then put forward to ensure the continuous improvement of forest farmers’ ecological rights and interestsprotection system and law enforcement systemand to ensure the realization of forest farmers’ rights to know, participate and relieve.
