关于行政法总则的期望与构想

制定行政法总则对于推进法治政府建设,完善中国特色社会主义法律体系具有重要意义。我国制定行政法总则的时机已经成熟,我国的行政立法实践已经走出了中国特色创新之路,党和国家对法治政府建设的强力推动,为制定行政法总则夯实了基础和条件保障。行政法总则的制定,应当以提取公因式的方法,将行政法律体系中已有的或应该有、可能有的共有普遍性和引领性规范提取出来,作出统一规定,既构建我国行政法律制度的基本框架,也为各分编的规定提供依据。从行政法总则到行政法典的制定,是完善中国特色社会主义法律体系的重要步骤,是促进我国建成法治政府的极为重要的举措和通道,也是对世界行政法发展的巨大贡献。

The formulation of the general principles of the administrative law is of great significance for advancing the construction of a government under the rule of law and improving the socialist legal system with Chinese characteristics.The practice of administrative legislation in our country has embarked on a path of innovation with Chinese characteristics.The Party and the state have strongly promoted the construction of a government under the rule of law,which has laid a solid foundation and guarantees for the formulation of the general rules of the administrative law.The formulation of the General Principles of Politics and Law should be based on the method of extracting common factors,extracting the common universality and leading norms that have been,should be,and may be in the administrative legal system,and make unified regulations,which will not only construct the Chinese administrative legal system.The basic framework also provides the basis for the regulations of each division.The formulation of the general principles of the administrative law and the administrative code is an important step to improve the socialist legal system with Chinese characteristics,an extremely important measure and channel to promote the establishment of a government under the rule of law in my country,and a great contribution to the development of world administrative law.
