论集体经济组织吸收新成员事项的立法规制--以湖北省农村集体产权制度改革的地方实践为背景

The Legislative Restrictions on the Absorption of New Members by Rural Collective Economic Organizations:Based on the Local Practice of Rural Collective Property Right Reform in Hubei Province

在农村集体产权制度改革完成后,应在农村集体经济组织法中对潜在新成员类型化为国家安置的移民、现有成员的子女和配偶以及其他自愿申请者三种。但上述潜在新成员并不宜全部通过集体自治的方式取得成员资格。对于国家安置的移民,应明确规定依法取得成员身份,但自愿投靠亲友并放弃安置到农村集体经济组织者除外;对于现有成员的配偶、子女,应规定其申请成员身份时,农村集体经济组织不得拒绝。同时,在立法中应明确,成员的配偶、子女取得成员身份后,仍属于相关取得土地承包经营权农户的“家庭成员”。对于上述两种类型之外的其他自愿申请者,应尊重集体自治,而不宜在立法中强制规定取得成员身份的“对价”。同时,应将表决方式限定为“人头多数决”。

with the completion of the reform of the rural collective property right system,it is necessary to classify in the rural collective economic organization law the potential new members into three types,namely,the migrants who are resettled by the state,the children and spouses of the existed members,and other voluntary applicants.The above-mentioned potential new members are not suitable to obtain membership through collective self-governance.For the migrants resettled by the state,it should be clearly stipulated that they should obtain membership according to law,except for those who voluntarily join their relatives and friends and give up resettlement to rural collective economic organizers.For the spouses and children of existing members,it should be stipulated that the rural collective economic organizations shall not refuse their applications for membership.At the same time,it should be made clear in the legislation that the spouses and children of the members still belong to the“family members”of the relevant farmers who have obtained the land contract management right.For those voluntary applicants other than the above two types,collective autonomy should be respected,and the“consideration”for obtaining membership should not be stipulated in legislation.Meanwhile,the voting method should be limited to“majority vote”.
