摘要
在房屋买卖中合同的认定是一个不容忽视的问题,其中关于合同效力的认定在司法实践中也是百辩不一。本文将合同认定所涉及的实务操作和有关合同无效的部分理论问题两相结合,在分析实务架构本身的同时辅以近年的合同效力认定的数据趋势,从学理上寻求合同无效中有关效力性强制性规定的界定标准。通过对合同无效纠纷和民间借贷纠纷的数据化分析,从大数据的直观角度查明实务运行中的遗漏之处,全方位的充实合同纠纷中有关效力认定的审查要点,始终围绕着司法公正与利益平衡展开论述。
The identification of contracts in house sales is an issue that cannot be ignored.Among them,the identification of contract validity is different in judicial practice.This article combines the practical operations involved in contract determination and some theoretical issues related to contract invalidity.While analyzing the practical framework itself,it is supplemented by the data trend of contract validity determination in recent years,and seeks for the validity of contract invalidity from the theoretical point of view.Stan-dards for defining sexual provisions.Through the data analysis of contract invalidity disputes and private lending disputes,the omis-sions in the actual operation can be identified from the intuitive perspective of big data,and the review points of the validity determi-nation in the contract disputes have been fully enriched,and the review points of the contract disputes have always been centered on judicial justice and Unfolded by the balance of interests.
