Necessity and Recommendations for Revising the Regulations for Water&Hydropower Project-related Resettlement

《大中型水利水电工程建设征地补偿和移民安置条例》于1991年颁布后,先后经历了多次对个别条款的修订。全面梳理条例实施中遇到的问题,根据其性质分为专章问题、条款问题、其他问题三大类。针对后期扶持和监督管理两个专章,移民工作管理体制、停建通告、移民安置协议、移民安置年度计划及淹没线上实物补偿五个条款,以及移民权益、不确定性用词两个其他问题,提出专题研究建议,意在对这一条例的研究、修订提供思路和参考。

The Regulations for Major Water and Hydropower Project-related Land Compensation and Resettlement,since revised and put into effect as issued by the State Council in 2006,has been amended only in some clauses over the past 15 years.On the basis of an overall research of the Regulations,problems arising the course of enforcement are divided into three categories in account of their nature,namely,special problems,clause problems,and others.Recommendations are also provided for a special study of two chapters,i.e.,post-resettlement support,supervision and management,five clauses regarding resettlement management system,notice of suspension,resettlement agreement,annual resettlement plan,and compensation for entitlements above the inundation level,as well as two other problems,namely,resettlers’entitlements and uncertain wording.We are hoping to provide ideas and references for studying and revising the Regulations.
