惩治网络犯罪国际警务合作的理论基础与路径考量

Theoretical Basis and Path Consideration on International Policing Cooperation in Punishing Cyber Crime

惩治网络犯罪国际警务合作的理论基础是网络主权,网络主权独立的实质是国家主权独立及领土完整原则在网络空间的展现,网络安全权处于核心地位,也是网络主权独立的前置性权利。为有效实现惩治网络犯罪的目的,在侦查活动中加强各国执法机关的相互配合就显得尤为重要,其中警务合作是执法合作的重要组成部分。惩治网络犯罪国际警务合作,应强化国际刑警组织在国际警务合作中的协调作用,加强惩治网络犯罪国际立法和国内立法二元模式的协调配合,丰富惩治网络犯罪国际刑事司法协助中的警务合作模式,拓展各国警务部门与其他利益攸关方惩治网络犯罪国际合作的方式。

The globalization of cyber crime has led to the huge invasion of national security,economic security and privacy security of ordinary people.This transnational crime requires the international policing community to make comprehensive and effective arrangements for this growing cyber crisis.The complexity of the cyber crime constitutive requirements and influence range of universality for existing legislation,judicature,law enforcement mechanism has brought the huge challenge,in punishing criminal networks of various kinds of institutional framework,the international policing cooperation is relatively mature and improve the mechanism of the organizational structure of the framework and arrangement,in full respect for the network sovereignty principle,adhere to the national sovereignty in the network space power under the premise of international cooperation have realistic possibility and interest to expect.From the perspective of legislation coordination of international and domestic policing cooperation,improvement of cross-border electronic evidence collection mechanism,criminal intelligence sharing and other international judicial mutual assistance and cooperation mechanisms of police,this paper proposes diversified ways of international cooperation in punishing cybercrime.
