海南自由贸易港外国人流动管理问题研究

Research on the Management of Foreigners’Flow in Hainan Free Trade Port

建设海南自由贸易港是国家新一轮改革开放的先行地和制度创新的"试验田",人员的自由流动是自由贸易港建设的基础性特征,外国人流动的自由度可以反映海南自由贸易港的整体开放程度,而将外国人管理好则直接影响着自贸港安全、稳定和发展。当前,海南自由贸易港外国人频繁自由流动导致各类社会风险日益加剧,相关法律法规体系支撑薄弱、出入境严格管控与人员自由流动矛盾、便利措施落地难、管理数据共享难等管理中存在的问题使公安机关等职能部门对外国人流动的管理难以更好地服务于自贸港的建设,亟须改变。

The building of Hainan Free Trade Port represents a prelude to the new round of national reforms and opening-up and a"pilot zone"of institutional innovations.The construction of free trade port is characterized by the free flow of people,and the freedom of flow among foreigners reflects the overall openness of Hainan Free Trade Port,whose safety,stability,and development directly hinge upon the proper management of foreigners.As of now,the frequent free flows of foreigners in Hainan Free Trade Port led to aggravating social risks,but the public security authorities confront challenges such as the feeble support of laws and regulations,the strict control of exit and entry versus the free flow of people,the difficulty in implementing facilitation measures,and the difficulty in managing data sharing,which prevented proper management of the flow of foreigners for the sake of better building the free trade port.Therefore,corrective measures must be adopted promptly.
