高压电运维经营者免责与减责措施研究

Study on Measures of Exemption and Reduction of Liability for Operators of High-Voltage Electric Power Operations

根据《民法典》侵权责任编第一千二百四十条的规定,从事高压电经营活动造成他人损害的,其经营者应当承担侵权责任,并适用无过错责任原则。为规避法律风险,页岩气勘探开发企业可通过推进管理制度建设、加强现场用电管理、强化承包商主体责任,以及积极运用免责或减责措施等,有效防范电力安全事故,最大限度地减少承担侵权责任的情形。

In accordance with the provisions of Article 1240 of the Tort Liability of the Civil Code,the operator shall bear the tort liability and apply the principle of no-fault liability if he engages in high-voltage electric power business activities to cause barage to others.In order to avoid legal risks,shale gas exploration and development enterprises can effectively prevent electric power safety accidents and minimize the cases of tort liability by promoting the building of management system,strengthening the management of on-site electricity consumption,consolidating the main responsibilities of contractors,and vigorously applying the measures of exemption or reduction of liabilities.
