On the Legislation of Prison Enterprises

监狱企业与劳动改造是监狱罪犯劳动生产的一体两面,是监狱刑罚执行中形式与内容的关系,监狱企业是劳动改造的载体,劳动改造是监狱企业的本质内容。因此,对监狱企业立法必包括劳动改造。监狱企业立法的思路:一种是不再设立《监狱法》,而设立《刑罚执行法》,其中分设监狱企业章和劳动改造章;第二种是修改《监狱法》,其中设立劳动改造专章,将监狱企业设为其中的一节。然后,分别根据监狱企业和劳动改造形式与内容进行规制。

Prison enterprises and labor reform are two subjects of the labor production of prisoners,and they are the relationship between the form and content of prison sentence execution.Prison enterprises are the carrier of labor reform,and labor reform is the essential content of prison enterprises.Therefore,legislation for prison enterprises should include the content of labor reform.There are two kinds of thought of the legislation of prison enterprises:One is to establish the Punishment Enforcement Law instead of Prison Law,and set chapters of prison enterprise and labor reform;the second is to amend the Prison Law and set a special chapter of labor reform,which includes the content of the prison enterprise.Then,it can be regulated according to the form and content of prison enterprises and labor reform.
