日本对唐律的移植在彼时具有现实可能性,并产生了有益的影响,即形成了律令时代。其中,“罪与罚”在日本律令时代的形成与发展中发挥了至关重要的作用,是日本移植唐律过程中的关键环节。尽管唐律对于日本而言是先进的,但这并不意味着其在日本完全适用。因此,日本在移植唐律的过程中进行了变通,即对唐律实行本土化改造,使其具备本土性。日本律不断移植与变通唐律的过程,是不断丰富中华法系的过程,也是中华法系中极具特色的存在。

Japan′s transplanting of Tang laws had a realistic possibility at that time and had a beneficial influence,which caused the formation of the era of laws and decrees.The"crime and punishment"played a crucial role in the formation and development of Japanese laws and decrees era,and was a key link in the process of transplanting Tang laws into Japan.Although Tang law was advanced to Japan,it did not mean that it was fully applicable in Japan.Therefore,in the process of the transplanting,Japan made some adaptations,to make Tang laws local.The process of Japanese laws′transplanting and modifying is a process of enriching Chinese legal system,and a distinctive existence in Chinese legal system.
