《1981年英国国籍法》研究及对我国的启示

A Study of the British Nationality Act 1981

《1981年英国国籍法》蕴含着规范国籍管理、维护国家主权和安全、尊重和保障人权的目的价值,遵循承认双重国籍、国籍权保护、非歧视性的重要原则,具有可操作性强、重视立法衔接、赋权与限权相结合等特征,对《中华人民共和国国籍法》修改完善具有借鉴意义。提出细化制度规定提高可操作性,突出国籍权保护原则尊重公民自由选籍,渐进式改革“不承认双重国籍”制度等加强我国国籍管理的建议。

The British Nationality Act 1981 aims at regulating nationality management,safeguarding national sovereignty and security,respecting and protecting human rights,as well as sticking to the important principles of recognizing dual nationality,protecting nationality right and nondiscrimination which is characterized as having strong operability,attaching importance to legislative cohesion,and focusing on the combination of empowerment and restriction.Therefore it can provided an important reference for the improvement of China’s Nationality Law.This paper puts forward some suggestions for refining system provisions,improving operability,highlighting the protection principle of nationality rights,respecting citizens’free choice of nationality,and gradually reforming the system of“not recognizing dual nationality”.
