检察机关法医技术性证据审查的发展进路

The Development Approach of Forensic Technical Evidence Review in Procuratorial Organs

司法体制改革后,检察机关涉及法医鉴定案件的内容发生了很大变化,已经形成“从以鉴为主兼顾审,到以审为主兼顾鉴的职能转变”趋势,强化法医技术性证据审查工作是强化检察监督效能的必由之路之一。从重庆市检察机关的司法实践实务案例进行考察审视,可以发现当下检察机关在法医技术性证据审查工作中成效斐然,但也存在规制不全、参与不高、保障不力、效能不佳等现实问题。结合司法实践需要,应当从统一鉴定依据、明确审查范围,规范审查方式、提升监督效能,优化人才配置、建设专业队伍等方面加以完善,力图构建行之有效的检察机关法医技术性证据审查工作机制,充分发挥其应有的作用。

After the reform of the judicial system,the procuratorial organs involved in forensic appraisal cases have undergone great changes,and have formed a trend of"from the focus on appraisal and examination to the function of examination as the main consideration and appraisal",strengthening the examination of forensic technical evidence work is one of the only ways to strengthen the effectiveness of procuratorial supervision.From the review of the judicial practice cases of the prosecutors in Chongqing,we can find that the current prosecutors are very effective in the review of forensic technical evidence,but there are also practical problems such as incomplete regulation,inadequate participation,ineffective protection,and poor effectiveness.Combining the needs of judicial practice,it should be improved in terms of unifying identification basis,clarifying the scope of review,standardizing review methods,enhancing supervision efficiency,optimizing the allocation of talents,and building professional teams,and strive to build an effective forensic technical evidence review mechanism for procuratorial organs to give fully play to its due role.
