The Abdication of Land Contract Right:Policy Evolution,Connotation and Key Problem

土地承包权退出是推进城镇化和农业现代化发展的重要组成部分。基于制度变迁理论,结合政策梳理和实践归纳,本文试图剖析土地承包权退出内涵纷争的内在逻辑,总结其核心要义,以规范理论界对土地承包权退出的理解。本文认为,土地承包权退出认识纷争与制度演进阶段有关,从长远来看,土地承包权退出应该以自愿有偿为前提,以放弃土地承包权为结果,具有阶段性和层次性特征。在实践层面,土地承包权退出改革试点得以推广实施的关键在于解决退出补偿资金来源问题、退出后农地利用问题和风险防范问题。为此,本文建议建立政府和市场双重支持体系下的承包权退出补偿机制、建立整合土地和完善交易平台基础上的承包权退出利用机制、建立多措并举的承包权退出风险防范机制。

The abdication of land contract right(LCR)has become an important part of promoting urbanization and agricultural modernization.Based on the theory of institutional change,this paper,combining policy review and practice induction,attempts to analyze the internal logic of the controversy of the abdication of LCR and summarizes its core connotation to enhance the understanding of it.The article considers that the dispute of the abdication of LCR is related to the evolvement of institution.In the long term,voluntariness and compensation should be the premise of the abdication of LCR,waiving the LCR the result,stage and hierarchy the characteristics.At the practical level,the key to policy promotion and implementation is to solve the problem of compensation funds,land utilization and risk prevention.Hence,this paper suggests establishing the compensation mechanism under the dual support system of government and the market,the utilization mechanism on the basis of integrating land and improving trading platform system,and the risk prevention mechanism through various measures.
