摘要
随着大数据应用的不断深入,相关垄断问题更加复杂。从大数据的生产要素内涵角度认识其垄断实质,能够增强对潜在垄断问题的识别和分析能力,完善反垄断规制理论和法律适用。对其生产要素内涵的研究表明,大数据扩大了网络效应的外延形成大数据网络效应,网络效应的反垄断分析应当分别考虑传统网络效应和大数据网络效应的竞争影响,特别是注意两者竞争影响强度评估方法的差异;大数据改造了范围经济的反垄断适用,扩张了集群商品竞争相关市场界定的适用范围,应当在"最小产品组合界定法"的基础上增加集群商品适格检验,并重视消费者偏好验证。
With the deeper application of big data,related monopoly problems are more complex.Understanding the monopoly essence of big data from the perspective of its intension of production factors could enhance the ability to identify and analyze potential monopoly problems,improve the anti-monopoly regulation theory and the application of Anti-monopoly Law.The research on its production factor intension shows that big data expands the extension of network effect as big data type,so the anti-monopoly analysis of network effect should consider the competition effect of traditional network effect and big data network effect separately,especially for the difference between the assessment methods of their competitive effects strength.Big data also transforms the anti-monopoly application of scope economy,expands the application scope of the market definition regarding cluster products competition,which should be considered on the basis of the"Minimum Product Group Definition Method"while adding the inspection step of identifying cluster commodities in it and enhancing the verification of consumer preferences.
