论流域管理法律制度的实施机制

On the Implementation Mechanism of Watershed Management Legal System

实施机制是将流域管理法律制度优势转化为流域治理效能的关键。然而,无论是传统的"分部门、分级实施模式",还是现行的"流域与区域相结合实施模式",均难以充分适应流域空间对实施机制的特殊需求。当前,以流域综合管理为内容、以强化流域层级管理和地方各级政府统筹为重点的"分级、分区域综合实施模式",是对现行实施机制的"升级",可作为未来流域管理法律制度实施机制的发展目标。具体可通过重塑流域管理机构、强化地方各级政府责任、以部门间整合式执法代替单一式执法加以实现。

The implementation mechanism of watershed management legal system is the key to transform the institutional advantages into governance efficiency.However,either"the implementation by divisions as well as by levels"or"the combination implementation of local administrative and watershed management"are difficult to fully adapt to the special needs of watershed space for implementation mechanism.At present,"the integrated implementation by levels as well as by administrative areas"has become the development goal of the implementation mechanism of watershed management legal system in the future.It is an upgrade of the existing implementation mechanism,with the content of integrated watershed management and the focus on strengthening the hierarchical management of watershed and the overall planning of local governments at all levels.In order to promote its construction and final formation,we should reshape the watershed management agency,strengthen the responsibility of the local government at all levels,and replace the unitary law enforcement with the integrated law enforcement.
