摘要
权力运行不仅需要用权者的自我约束,同样需要来自外部的监督和制约。在构建对权力的规制机制时,监督与制约这两种机制存在逻辑上的差异,需要区别对待并分别审视。就监督而言,在现行宪法和法律法规的范围内,人大监督与群众监督是避免循环监督的最合理的规制路径,但这一方式仍然需要创新和完善;就制约而言,监察权与检察权之间构成程序性的制约关系,但维持制约关系的有效性需要关注制约双方的平衡构造。同时,应充分调动执政党领导监督和监察委内部监督的积极作用,通过维系并优化既有的监督与制约机制,从而达致监察全覆盖推进过程中的监察权健康运行。
The operation of power requires not only the self-discipline of the power users,but also the regulation of the operation process.This regulation usually manifests itself in the restriction and supervision of power.When constructing a regulatory mechanism for power,there are logical differences between the two methods of restraint and supervision,and cannot be confused.As far as supervision is concerned,within the scope of the current Constitution and laws and regulations,the supervision of the NPC and the supervision of the people are the most reasonable regulatory path to avoid the construction of circular supervision,but this method still needs innovation and improvement;in terms of constraints,the procuratorial power and the supervisory power constitute a phased constraint between the procedures.To maintain the stability of this constraint,it is necessary to properly balance the two.At the same time,the positive role of the leadership of the ruling party and the internal supervision of the Supervisory Committee should be fully mobilized,so as to maintain and monitor the existing monitoring and control mechanisms to achieve the full operation of monitoring and the healthy operation of the supervisory power.
